This Information explains how INEOST S.R.L., with registered office in Guidonia, Via Degli Olivetani 10, c.f. e.i. 11770890967,.c e.g. indarcostruzioni@pec.it, as data controller, pursuant to European Regulation 679/2016 (hereinafter also, “we”) collects, uses, shares and processes your data and information concerning you, as well as what your rights are with respect to such processing and what choices you have available to control your personal data.

This Policy concerns all processing carried out by us on your personal data, collected during your use of our website SPATIA.IT (“Site”) as well as during other interactions with us.

We may change this Policy at any time: therefore, each time you access the Site or use one of our services, we invite you to read the updated Policy. If you continue to use the Site or access our services, you consent to the processing of your personal data as provided in the version of the Policy in force at the time of your use / access. In any case, when required and necessary, we will request your consent and notify you of major changes.

 

Personal data we collect

“Personal data” means any information that allows us to identify you, either directly or indirectly.

The types of personal data we collect depend on the type of interaction we have with you, and may include:

  1. your identification and contact data (for example name, surname, postal address, e-mail address, telephone etc.);
  2. payment data (e.g. type of payment, credit card details);
  3. data relating to our business relationship, in particular our interactions and contracts (e.g. order history, interactions with our customer service, etc.),
  4. geolocation data (we collect your consent when it is required by law)
  5. the data necessary for the implementation of loyalty, marketing, market research and survey actions;
  6. the navigation data of the Site and the use of our other sites and mobile applications, as well as our communications (for example number of visits, pages visited, opening of our messages etc …).

We collect your personal data, in particular, when:

  1. visit our Site, which uses cookies and other tracking tools;
  2. contact us through online forms, e-mail, telephone or other means;
  3. you create an account to access our services from your computer or smartphone;
  4. subscribe to our newsletter;
  5. you purchase a product or service;
  6. respond to one of our studies or satisfaction surveys;
  7. interact with us on social networks.

We may also obtain information about you through other group companies or partners, subject to the collection of consent when required by applicable law.

Cookies and other tracking technologies

We may use cookies, tags and similar technologies to automatically collect information about our services. These tracking technologies allow you to collect information including your computer’s IP address, mobile device identifier, the type of internet browser you are using, operating system, referring URL, stamp date/time stamp, pages viewed, and simple keyword tags. We also use web pixels to analyze usage patterns on our site.

  1. Cookies. Cookies are small web files that the site or its provider transfers to your device’s hard drive through your web browser that allows the site’s or provider’s system to recognize your browser and remember certain information. In general, we use first and third-party cookies for the following purposes: to make our services work properly; provide a safe browsing experience while using our services; collect passive information about your use of our services; measure how you interact with our marketing campaigns; improve our services; to remember your preferences.

For example, these cookies may be used to remember your name or preferences on our services. We do not use functional cookies to send you online marketing proposals. Although these cookies can be disabled, this may result in less functionality when using our services.

Performance cookies or Analytic. These cookies collect passive information about your use of our services, including the web pages you visit and the links you click. We use the information collected by these cookies to improve and optimize our services. We do not use these cookies to send you online marketing proposals.  You can disable these cookies.

Advertising or Targeting Cookies. These cookies are used to make advertising messages more relevant to you. They perform functions such as preventing the same ad from continuing to reappear, ensuring that ads are correctly displayed to advertisers and, in some cases, selecting advertisements that are based on your interests.   1. Other traceability technologies.   2. Mobile Advertising. If you are not located in European countries, you can choose that your mobile advertising identifiers are not used for certain types of advertising by going to your mobile device settings and following the instructions. If you give up, we will remove all data about you and will not collect any further data. The random ID previously assigned to you will be removed. Thus, if at a later stage, you decide to choose this option, we will be able to continue monitoring the user using the previous ID and for all practical purposes will be a new user. If you are located in European countries, the cookie banner on our Site will give you the opportunity to consent to the use of your mobile advertising identifiers for certain types of advertising by accessing the settings of your mobile device. 
  1. Third-party cookies. We do not control the collection or use of information by third parties for interest-based advertising. However, these third parties can make you decide how your information is collected or used.   1. D. Analysis Services. If you are not located in European countries, we may use third-party service providers to track and analyze the use of our Site. Currently, we use Google Analytics. Google Analytics is a web analytics service offered by Google LLC (“Google”) that tracks and reports site traffic. If you are located in European countries and Google Analytics is structured to collect personal data, the cookie banner on our website will give you the option to consent to Google Analytics. 
  2. E. Behavioral & Remarketing. We also use remarketing services to advertise on third-party websites after you visit our Site or use one of our services. If you are not located in European countries, we and our third-party providers will use cookies to inform, optimize and serve ads based on your visits to our Site. For these purposes we use Google Ads. The Google Ads remarketing service is provided by Google. You can opt out by visiting the Google Ads Settings:  http://www.google.com/settings/ads  page. If you are located in European countries, and Google Ads is structured to collect personal information, the cookie banner on our Site will give you the opportunity to give consent to Google Ads. 
  3. F. Other traceability technologies. We may also use tracking technologies to collect “click stream” data, such as the domain name of the service that provides access to the Internet, the type of device, IP address used to connect your computer to the Internet, the type of browser and version, operating system and platform, the average time spent on our Site, the web pages viewed,  the content searched, access times and other relevant statistics, assign unique identifiers to the device or other credentials used to access the Site for the same purposes. 

The pages of our site and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags and single-pixel gifs) that allow us, for example, to count users who have visited those pages or opened an e-mail and for other statistics related to the website (for example,  recording the popularity of certain website content and verifying the integrity of the system and server).

The pages of our Site may also use Java scripts, which are code snippets embedded in various parts of websites and applications that facilitate a variety of operations, including accelerating the process of updating certain features or using traceability of various online components; entity tags, which are the HTTP code mechanisms that allow parts of websites to be stored or “cached” within the browser to speed up the performance of the Site; HTML5 local storage, which allows you to store data from websites or “cached” within the browser to store and retrieve data in HTML5 pages when the site is revisited.

  1. G. “Do Not Track”. Some Internet browsers, such as Internet Explorer, Firefox, and Safari, include the ability to transmit “Do Not Track” or “DNT” signals. Since the uniform standards for “DNT” signals have not been adopted, our site does not process or respond to “DNT” signals. 
  2. H. Location Information. You may be able to adjust your device settings so that your physical location information is not sent to us or third parties, (a) by disabling location services within your device settings; or (b) denying certain websites or mobile applications permission to access location information by changing your mobile device preferences and permissions or browser settings. Please note that the location can be intercepted by WiFi, Bluetooth and other device settings.  See your device settings for more information.

How we use your personal data

We will use your personal data as described in this Policy or as a communication to you prior to processing:

  1. A. To respond to your requests/complaints and to provide you with our services (performance of a pre-contractual or contractual obligation). We will use your personal data to provide you with the information and assistance you have requested or to perform the services you have requested, including managing your request as a registered user of our Site. If the applicable information is to be provided or the service is to be performed by a third party, we will share your necessary data with the third party to provide you with the information or perform the requested services. All third parties we work with are contractually obligated to protect the information provided in this Policy.
  2. B. To conduct studies and analyses (legitimate interest: to improve the knowledge and behaviour of our customers and users). We use your personal data to ensure the quality of our products and services, improve our commercial performance, as well as the content and functionality of our Site, analyzing where, on what types of devices and how our Site is used, how many visitors we receive and from where they access the Site.
  3. C. Provide mandatory communications related to the service (execution of a legal obligation). We will send you administrative or account-related information to keep you updated on your account and services. Such communications may include information about updates related to Privacy or the General Conditions, confirmations of actions or transactions of your account, security updates or suggestions or other information related to transactions. We process your contact details to send you such communications. Communications relating to the services are not promotional in nature. 
  4. D. To ensure the security of the services (legitimate interest: to provide secure systems). We take care to keep you safe while using our services. Your security requires that we process personal information, such as device information, activity information, and other relevant information. We use this information to combat spam, malware, malicious activity or security risks; improve and apply our security measures; and to monitor and verify your identity so that unauthorized users do not gain access to your information. We cannot guarantee the security of our Services if we do not process your personal data. 
  5. And. Ensure compliance with our legal obligations (legitimate interest: prevention of legal actions and sanctions – fulfillment of legal obligations). Our services are subject to certain laws and regulations that may require us to process your personal data. For example, we process your personal data to ensure compliance with tax obligations, and in general to fulfill our legal obligations arising from our business activity. Without processing your personal data for such purposes, we cannot perform the Services in accordance with our legal and regulatory requirements;
  6. F. Manage our marketing operations (consent). We use your personal data, with your consent, to send you advertising campaigns (digital and non-digital), provide targeted online advertising and customize content according to your needs, including through profiling methods.

Sharing your personal data

In addition to sharing your personal data so that we can use our services, or as required or permitted by law, we may disclose your personal data as described below.

  1. A. Within our corporate organization. We may share your personal data within this organization to provide you with the services and take action based on your request.
  2. B. Third Parties. We may share your personal data with third-party service providers who act on our behalf to help us operate our services. These third parties may only use your data in accordance with our written instructions and must comply with the information security protection we have put in place. In addition, we may share your personal data as required by law, or when we believe that disclosure is necessary to protect our rights and/or comply with a request from the judicial authority or any other proceeding, including out of court. In case of sale or purchase of our business, we may disclose your personal data to the new (or potential) owner of the company. 
  3. C. Third Party Advertising. In certain circumstances, and in compliance with applicable law, we may share your personal data with third parties to market their products or services to you.
  4. D. Co-Brand Services and Features. Parts of our Site or services may be offered as part of co-branded services and features. We will share your personal data with our co-brand partners based on your consent or participation in a co-branded service or feature. Co-brand partners will be identified according to the co-branding service, along with the applicable co-brand partner’s privacy policy. The use of your personal data by a co-brand partner will be subject to the privacy policy of that co-brand partner, as a stand-alone owner. 
  5. E. Consent. We may share your personal data for any purpose with your consent.

Transfer of your personal data

When you access or use our services, your personal data may be processed or transferred outside the EEA. Such countries or jurisdictions may have data protection laws that are less protective than the laws of the jurisdiction in which you reside. For these transfers we use appropriate safeguards, as permitted by the GDPR, with the Standard Contractual Clauses, contracts with certified Privacy Shield companies, and/or transfer of personal information pursuant to Article 49 (1) (b) GDPR to provide our services in accordance with the General Conditions. If you do not want your information to be transferred, processed or maintained outside of the country or jurisdiction in which you are located, you must immediately stop accessing the Site and using our services. Safety precautions

We adopt physical, electronic and procedural safeguards to protect and prevent the misuse of your personal data. Our security measures include industry-standard physical, technical and administrative measures to prevent unauthorized access or disclosure of data, to maintain its accuracy, to ensure its appropriate use and to safeguard it from threats. We limit access to non-public personal information to employees and third parties who need such information to provide products or services.

Where possible, your data is processed in the European Economic Area (EEA). However, since some of our service providers or their sub-processors are located in countries outside the EEA, your personal data may be processed in those countries. Some of these countries may have different personal data regulations than the European Union. In such a case, (i) we take special care to ensure that such transfer is carried out in accordance with applicable regulations and (ii) we put in place safeguards that ensure an adequate level of protection of your privacy and fundamental rights (in particular by using the standard contractual clauses of the European Commission).

The protection of personal data is also your responsibility. We ask that you be responsible for safeguarding your password and other authentication information that you use to access our services.

Archiving

In accordance with the legislation on the protection of personal data, we undertake to keep your personal data for the time necessary to achieve the purposes pursued, to respond to your needs, to perform our legal obligations.

In order to determine this duration, we consider, in particular, the following criteria:

  1. the duration of the contract;
  2. the time necessary to process your request or complaint;
  3. the length of time your account is active;
  4. your interest in our brands;
  5. the need to keep a history of your interactions with us for the good management of our business relationship. This duration varies depending on whether you have purchased a product or service, or just interacted with us without signing contracts;
  6. our legal obligations.

When the data is no longer needed, it is deleted from our systems and logs or anonymized so as to make it impossible for you to identify it. We may need to retain some of your personal data for a longer period, in a separate archive, so that we can defend ourselves in legal proceedings, until the end of the limitation period provided for by applicable law.

Third Party Websites

Our site may contain links to third-party sites. This Policy does not apply to such third-party sites. We recommend that you read the privacy policies of any other site you visit as we are not responsible for the privacy practices of those sites.

Minor

Our services are not directed to children under the age of 16 and we do not knowingly collect their personal information. If you are under the age of 16, do not attempt to fill out our forms or submit your personal information to us. If we become aware of the personal information you have provided to us, that you are under the age of 16, we will take steps to delete that information from our records.

Your rights

The legislation on the protection of personal data guarantees you the following rights:

  1. the right to object to the processing of your personal data, for reasons related to your particular situation, and the right to request the limitation of the processing of your personal data, in the cases provided for by law;
  1. the right to object to any processing for marketing purposes: you can ask at any time to no longer receive communications relating to our offers, news and events. This right can be exercised, in particular, through the unsubscribe link in each e-mail for marketing purposes. You can also object to profiling;
  1. the right to withdraw your consent at any time, for the purposes for which it was issued;
  1. the right to information: you have the right to obtain clear, transparent and comprehensible information about how we use your personal data and your rights. This policy is an example of this;
  1. the right of access to your personal data: you have the right to obtain information on the processing of your personal data (including the data used, for what purposes, etc.) and a copy of the same;
  1. the right to rectification: you have the right to correct your data if it is inaccurate or incomplete, despite our efforts to keep it updated, while allowing us to fulfill our obligation to have updated data;
  1. the right to the portability of your data, that is, under certain conditions, the right to receive the personal data you have provided to us, in a structured and commonly used computer format, and to transmit them to third parties, if technically possible;
  1. the right to erasure (or the right to be forgotten): you have the right to have your data erased. This right may be limited in light of our contractual obligations (ongoing contract) or legal obligations (prevention of legal actions in particular).
